Privacy Notice (KVKK)
Draft: this text is awaiting legal review; the data controller's details will be added. The Turkish text is the legally binding version.
Last updated: October 3, 2026. This is a translation; if the versions differ, the Turkish text prevails.
1. Data controller.
Under Turkish Personal Data Protection Law No. 6698 (KVKK), the data controller is to be confirmed, tax number to be confirmed, address: Belek Golf Garden Evleri, Belek Mah., Turizm Cd., 11 Sk., 07506 Serik / Antalya (“SD Realty”, “we”). Contact: sebastian.desigual@gmail.com, +90 537 486 38 96.
This notice covers the personal data you send us through the forms on our website, our Telegram bots, WhatsApp, phone and email.
2. Data we process.
- Your name.
- Contact details: phone number, Telegram username, email address.
- Enquiry details: the property or service you are interested in, dates and length of stay, number of people, budget, your message, the time slot you chose, the site language and the page the form was sent from.
- Your messages to us on Telegram, WhatsApp and email.
- Security data: IP address and server logs.
We do not ask for special categories of data (health, religion, ethnic origin, etc.). Please do not include them in your messages.
3. Purposes and legal grounds.
| Purpose | Legal ground (KVKK Art. 5(2)) |
|---|---|
| Reply to your enquiry, suggest properties, book a viewing or a service, prepare a rental or service contract | (c) Entering into or performing a contract |
| Provide the service you ordered (transfer, car hire, day trip, translation, advice) through our partners and send a reminder before your appointment | (c) Entering into or performing a contract |
| Keep a record of enquiries and protect our rights in a dispute | (e) Establishing, exercising or protecting a right |
| Meet our tax and other legal obligations | (ç) Legal obligation |
| Keep the site secure and count visits in aggregate, without cookies | (f) Legitimate interest |
None of these purposes relies on your consent, so we do not ask for it.
4. How we collect data.
We receive data electronically through the site forms, our Telegram bots, WhatsApp, phone and email. Form submissions go automatically into our enquiry sheet and notification channel. Outside working hours (10:00–20:00 Turkey time), an AI assistant replies on Telegram; it does not make decisions about you that have legal effects.
5. Who receives your data.
- In Turkey: partners who provide the service you ordered (transfers, car hire, day trips, translation, legal and financial advice), property owners and partner agencies — only what your request needs; public authorities — only when the law requires it.
- Outside Turkey: the technical services the site and our messaging run on — hosting and visit statistics (Vercel), automation (Make), spreadsheets and email (Google), messaging (Telegram, WhatsApp/Meta) and the AI assistant (to be confirmed). Their servers are outside Turkey. These transfers follow Article 9 of the KVKK: they are made under standard contracts issued by the Personal Data Protection Board and notified to the Authority.
6. How long we keep data.
Enquiries that do not lead to a contract: 1 year from the last message. If a contract is signed: 10 years after it ends. After that, we delete, destroy or anonymise the data.
7. Cookies.
The site itself does not use cookies; visit statistics are aggregate and cannot identify you. The map on the contact page loads from Google Maps only when you choose to load it; Google then receives your IP address and may use its own cookies.
8. Your rights (KVKK Art. 11).
You can ask whether we process your data and request information about it; learn the purpose of processing and whether the data is used for that purpose; know who in Turkey or abroad has received it; have incomplete or inaccurate data corrected; have it erased or destroyed under the conditions of Article 7; have corrections and erasures passed on to those who received the data; object to an outcome against you that results solely from automated analysis; and claim compensation for damage caused by unlawful processing.
9. How to contact us.
Send your request in writing to the address above; by registered electronic mail (KEP), secure electronic signature or mobile signature; or to sebastian.desigual@gmail.com from an email address you have already given us and that is in our records. Please include your full name, nationality and passport number (Turkish citizens: T.C. identity number), a postal address for official notices, your email and phone if you have them, and what you are asking for; a written request must be signed. We reply free of charge within 30 days at the latest; if a request involves extra cost, a fee may be charged under the Board’s tariff. If we reject your request, you are not satisfied with our reply, or we do not reply in time, you can complain within 30 days of our reply, and in any case within 60 days of your request, to the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu).
